Introduction
These Terms of Service (“Terms”) govern your use of the RedMalta website and its associated services (“Services”). RedMalta is a platform connecting travelers seeking vacation rentals (“Guests”) with property owners/managers offering such rentals (“Hosts”).
By accessing or using RedMalta Services, you agree to be bound by these Terms. If you disagree, do not use the Services.
1. Eligibility
- You must be at least 18 years old to use RedMalta.
- You represent that you have the legal authority to enter into this agreement.
2. User Accounts
- You must create an account to use certain features of the Services.
- You are responsible for maintaining the confidentiality of your account information and all activities occurring under your account.
- You must notify RedMalta immediately of any unauthorized account use.
3. Listings
- Hosts:
- Hosts can create listings describing their properties and set terms for their availability and pricing.
- Hosts are responsible for ensuring their listings are accurate, legal, and do not infringe on any third-party rights.
- Hosts set their own cancellation policies, which must be clearly stated in the listing.
- Guests:
- Guests can search and book listings through the RedMalta platform.
- Guests agree to abide by the terms of the listing they book, including cancellation policy, house rules, and any additional fees.
4. Bookings and Payments
- Bookings: Bookings are initiated by Guests and confirmed by Hosts. A binding contract is formed between the Guest and Host at the time of confirmation.
- Payments: RedMalta may facilitate payment processing, typically holding funds until after the Guest’s check-in. A service fee may be charged for each booking.
- Taxes: Hosts are responsible for any applicable tourism taxes, VAT, or occupancy taxes. Guests may also be responsible for such taxes and understand they may be collected separately.
5. Cancellations and Refunds
- Cancellations are governed by the Host’s specific cancellation policy, as stated in the listing.
- Any refunds due are subject to the cancellation policy and any applicable RedMalta service fees.
- RedMalta may mediate disputes, but cannot guarantee refunds outside of the stated cancellation policy.
6. Reviews and Ratings
- Both Guests and Hosts may leave reviews after a completed stay.
- Reviews must be honest, respectful, and not contain defamatory or discriminatory content.
- RedMalta reserves the right to remove reviews that violate its guidelines.
7. Disputes
- Guests and Hosts are encouraged to resolve disputes directly.
- RedMalta may offer mediation services to help resolve disputes.
- You agree that any legal action arising from your use of RedMalta will be governed by the laws of Malta and must be filed in the appropriate courts in Malta.
8. Limitation of Liability
- RedMalta is a platform and does not own or manage properties. RedMalta is not liable for any damages arising from Guest/Host interactions or property conditions.
- RedMalta will not be liable for indirect, incidental, or consequential damages relating to the Services.
- RedMalta’s liability will not exceed the service fees it earned in connection with the transaction at issue.
9. Intellectual Property
- RedMalta’s Services are protected by copyright, trademark, and other intellectual property laws.
- You may not use RedMalta’s content or trademarks without permission.
10. User Conduct
- You agree not to use RedMalta for any illegal or harmful purposes. This includes, but is not limited to:
- Discrimination
- Harassment
- Fraud
- Impersonation
- Spam
11. Changes to Terms
- RedMalta may modify these Terms at any time. You will be notified of significant changes. Your continued use of the Services indicates acceptance of the revised Terms.
